These terms govern your use of SiteAudit. They cover what the service is, what it isn't, the limits of what we promise, and what you agree to when you use it. By using SiteAudit, you accept these terms in full.
SiteAudit (the "Service") is operated by Next Level HTML, a web design and development agency based in Arlington, Texas, United States ("Next Level HTML," "we," "us," or "our").
By accessing or using SiteAudit, including running an audit, viewing a report, generating a PDF, creating a share link, or submitting any form, you agree to be bound by these Terms of Use in full. If you do not agree to these terms, you must not use the Service.
If you are using SiteAudit on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these terms, and "you" refers to both you individually and that entity.
SiteAudit is a free, automated website-analysis tool. When you submit a URL, the Service captures the live page, applies a series of measurement and analysis passes, and produces a report containing scores, findings, and recommendations across three categories: visual design, code quality, and frontend performance.
The Service uses a combination of deterministic measurements (real browser instrumentation, pattern matching, specification-based checks) and AI-generated explanations. The methodology is described in further detail on the How It Works page.
SiteAudit is provided at no monetary cost. We may introduce paid features, tiers, or related services in the future. If we do, those features will be governed by additional terms that you will have the opportunity to accept or decline.
The Service, including all audit results, scores, findings, recommendations, build-origin classifications, performance measurements, AI-generated text, and any other output (collectively, the "Audit Output"), is provided strictly "AS IS" and "AS AVAILABLE," with all faults and without any warranties of any kind, express, implied, or statutory.
We do not warrant that the Service will be uninterrupted, secure, error-free, free of viruses or other harmful components, or that defects will be corrected. We do not warrant that the Audit Output will be accurate, complete, current, or reliable. We do not warrant that use of the Service will achieve any particular result.
No advice or information, whether oral or written, obtained from Next Level HTML or through the Service shall create any warranty not expressly stated in these terms.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the maximum extent permitted by law, and the remaining provisions of these terms apply in full.
Audit results are interpretive in nature and represent one possible analysis of your website at one particular moment. Reasonable analysts using the same data could reach different conclusions. Audit Output is offered as a starting point for further investigation, not as a definitive judgment of your website's quality, value, fitness for purpose, or compliance with any standard.
The Audit Output is subject to both human and machine error, including but not limited to the following sources:
The explanations and recommendations attached to findings are produced by large language models, which are known to occasionally produce inaccurate, incomplete, or fabricated content ("hallucinations") despite our efforts to minimize this.
The build-origin classifier identifies platforms by fingerprint matching, which can produce false positives, false negatives, or fail to recognize novel or heavily customized stacks.
Performance measurements reflect network and server conditions at the moment of audit, which may not represent typical visitor experience. CDN behavior, caching, and geographic routing can all shift results between runs.
Most audits analyze one URL. The results may not represent the quality, performance, or design consistency of other pages on your site. A perfect home page audit does not guarantee a perfect site.
Web standards, accessibility guidelines, performance methodologies, and design conventions all evolve. The reference standards used at audit time may differ from current best practices by the time you read the report.
Translating raw measurements into a 0-10 score involves judgment. Our scoring weights and thresholds are opinionated. They are not the only valid way to summarize the underlying data.
Pages that require login, geo-restrict content, render entirely client-side after delayed JavaScript, block headless browsers, or use anti-bot defenses may produce incomplete or misleading captures.
Findings may be misread, applied to the wrong context, or acted on without sufficient consideration. The audit is not a substitute for professional design, development, or accessibility review.
Treat the audit as a smart starting point, not a verdict. Use it to surface things worth investigating, then confirm anything that matters with a qualified professional before acting on it. Especially for accessibility, legal compliance, performance commitments, or anything safety-critical.
You acknowledge that you are responsible for evaluating the accuracy and relevance of the Audit Output for your particular circumstances, and that any reliance on it is at your sole risk.

You are responsible for ensuring your use of SiteAudit complies with applicable laws, regulations, and the terms of service of the websites you submit for audit.
You agree not to use the Service to do any of the following:
We reserve the right, at our sole discretion and without notice, to investigate any suspected violation of these rules, to block or restrict access to the Service, to remove or refuse to display any submitted content, and to report violations to appropriate authorities.
You are solely responsible for:
You acknowledge that running an audit on a website you do not own may, in some jurisdictions, raise legal questions under computer-access laws. You are responsible for evaluating those questions before submitting any URL.
In no event shall the total aggregate liability of the Released Parties to you for all claims arising out of or relating to the Service or these terms exceed the greater of one hundred U.S. dollars ($100.00) or the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. You acknowledge that SiteAudit is provided free of charge, that the amount you have paid is zero, and that this limitation is a fundamental element of the bargain between you and us.
You expressly agree that you assume all risk arising from your use of the Service and the Audit Output. You waive any and all rights to seek damages, compensation, restitution, or any other remedy from the Released Parties in connection with the Service to the maximum extent permitted by law.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Next Level HTML and the other Released Parties from and against any and all claims, demands, actions, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of any such claim.
The Service, including its software, design, layout, text, graphics, scoring methodology, classifier fingerprints, prompts, AI workflows, and all underlying intellectual property, is owned by Next Level HTML or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. "SiteAudit" and "Next Level HTML" are trademarks of Next Level HTML.
Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and the Audit Output for your own internal business or personal purposes. This license does not include any right to reproduce, distribute, modify, create derivative works from, publicly perform, publicly display, or sublicense any part of the Service or its underlying methodology, except as expressly permitted herein.
The Audit Output you receive (the report itself) may be shared with collaborators, clients, or stakeholders in the ordinary course of using the Service. You may not resell or commercially distribute the Audit Output as a stand-alone product.
You retain all rights in and to the content of the website you submit for audit. By submitting a URL, you grant us a limited, non-exclusive, royalty-free license to access, capture, process, and analyze the content available at that URL for the purpose of producing the Audit Output, and to retain that data for the periods described in our Privacy Policy.
You represent and warrant that you have all rights necessary to grant the above license, and that your submission of the URL does not violate the rights of any third party.
If you choose to provide us with suggestions, ideas, or other feedback about the Service, you agree that we may use such feedback for any purpose without compensation to you and without any obligation of confidentiality.
We make no commitment regarding the availability of the Service. We may modify, suspend, discontinue, or restrict access to the Service or any of its features at any time, in whole or in part, with or without notice, and for any reason or no reason.
We may impose limits on certain features or restrict your access to parts or all of the Service without notice or liability. Rate limits, restricted-content screens, and other technical controls may be adjusted at any time.
We are not liable for any modification, suspension, or discontinuation of the Service, or for any loss of access to the Service or the Audit Output as a result.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason or no reason, including without limitation if we believe you have violated these terms. Upon termination, your right to use the Service ceases immediately.
Provisions of these terms that by their nature should survive termination shall survive, including without limitation the warranty disclaimers (Section 03), accuracy disclaimers (Section 04), limitation of liability (Section 08), indemnification (Section 09), intellectual-property provisions (Section 10), governing law (Section 14), and general provisions (Section 15).
The Service relies on third-party providers to operate (AI inference, email delivery, edge networking, analytics, hosting). The list of providers and the data they receive is described in our Privacy Policy. We are not responsible for the practices, content, or terms of any third-party service.
The Audit Output, by its nature, involves analysis of third-party websites you submit. We do not own, control, or endorse the content of any audited website, and the appearance of any URL in an audit does not constitute endorsement, affiliation, or recommendation by us.
The Service may contain links to third-party websites or resources. These links are provided for convenience only. We have no control over the content, accuracy, or practices of any third-party site, and we are not responsible for them.
These terms and your use of the Service are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You agree that any dispute, claim, or controversy arising out of or relating to these terms or the Service shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you hereby submit to the personal jurisdiction of those courts and waive any objection to venue.
To the extent permitted by applicable law, you and Next Level HTML each agree that any dispute will be resolved only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You waive any right to participate in a class action against Next Level HTML.
Any cause of action you may have arising out of or relating to the Service or these terms must be commenced within one (1) year after the cause of action accrues, or it will be permanently barred.
We may update these Terms of Use from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be posted at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the Service.
If any provision of these terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be interpreted to give effect to its intent to the maximum extent permitted by law.
Our failure to enforce any right or provision of these terms shall not be considered a waiver of that right or provision. No waiver is valid unless made in writing and signed by us.
You may not assign or transfer these terms or any of your rights or obligations hereunder without our prior written consent. We may assign these terms in connection with a merger, acquisition, sale of assets, or by operation of law without notice or your consent.
These Terms of Use, together with our Privacy Policy and any additional terms specifically incorporated by reference, constitute the entire agreement between you and Next Level HTML regarding the Service and supersede any prior agreements between the parties on this subject.
We are not liable for any failure or delay in performance under these terms that is due to causes beyond our reasonable control, including without limitation acts of God, war, terrorism, civil unrest, pandemic, government action, labor disputes, infrastructure failure, or third-party service outages.
No agency, partnership, joint venture, employment, or franchise relationship is created between you and Next Level HTML by these terms or your use of the Service.
Any notices to us under these terms must be sent to the contact address below. Notices to you may be posted on the Service or sent to any email address you have provided.
